Legal Insight | Party Autonomy in International Arbitration – Are Indian Parties Truly Free to Choose?

Party autonomy is one of arbitration’s greatest promises – the ability to choose arbitrators, shape procedures, and define the dispute resolution framework.

In theory, Indian law strongly supports this freedom. In practice, however, Indian parties often lose autonomy before the process even begins – by adopting boilerplate clauses, deferring to institutional defaults, or not actively shaping procedures and appointments.
